1. Acceptance of Terms

By accessing or using EquityMind (“the Service”), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

2. Description of Service

EquityMind provides software tools, AI coaching, market data, deal analysis, and educational content designed to help new real estate investors plan and evaluate investment opportunities. We do not provide legal, tax, financial, or investment advice. All outputs are informational only and should be verified with qualified professionals before any investment decision.

3. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscriptions & Billing

Some features require a paid subscription. Fees are billed in advance on a recurring basis unless canceled. You may cancel at any time through your billing settings; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with reasonable notice.

5. Refunds

Refunds are provided at our sole discretion, generally only when technical issues prevent access to the Service and cannot be resolved within a reasonable time. Trial periods are non-binding and may be changed or discontinued.

6. Acceptable Use

You agree not to:

• Use the Service for unlawful purposes or to violate any applicable law or regulation.
• Attempt to gain unauthorized access to our systems or other users’ accounts.
• Reverse engineer, scrape, or abuse the AI coach, APIs, or data feeds.
• Upload malicious code, spam, or content that infringes third-party rights.

7. Intellectual Property

All software, designs, logos, content, and data compilations provided by EquityMind are our property or licensed to us. You retain ownership of any data you input. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process personal data as described there, including account information, usage analytics, and communications with the AI coach.

9. Disclaimers

The Service is provided “as is” without warranties of any kind. We do not guarantee investment outcomes, market accuracy, or that any deal will be profitable. Real estate investing involves risk, including loss of capital.

10. Limitation of Liability

To the fullest extent permitted by law, EquityMind and its affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues arising from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless EquityMind, its officers, employees, and agents from any claims, damages, or expenses arising out of your use of the Service or violation of these terms.

12. Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Disputes shall be resolved in the state or federal courts located in Delaware.

13. Changes to Terms

We may update these Terms & Conditions from time to time. Continued use of the Service after changes constitutes acceptance of the revised terms. Material changes will be notified via email or in-app notice.
